1. Introduction

Welcome to ImageCraft. Please read these Terms of Service ("Terms") carefully as they govern your use of the ImageCraft mobile application ("App") provided by profileCraft ("we," "our," or "us").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the App.

2. License and App Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

You agree not to:

  • Copy, modify, or create derivative works based on the App
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Remove any copyright, trademark, or other proprietary notices from the App
  • Transfer, sublicense, lease, lend, rent, or otherwise distribute the App to any third party
  • Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App
  • Use the App to violate any applicable laws or regulations

3. User Content

"User Content" refers to any images, text, or other content that you process, edit, or create using our App.

You retain all rights to your User Content. You are solely responsible for all your User Content and confirm that you own or have the necessary rights to use any User Content processed with our App.

By using the App, you grant us a limited license to process your User Content on your device for the purpose of providing the App's services.

You agree not to use the App to process, edit, or create content that:

  • Infringes on the intellectual property rights or other proprietary rights of any party
  • Is illegal, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
  • Contains software viruses or any other computer code designed to disrupt, damage, or limit the functioning of any computer software or hardware
  • Violates any applicable laws, regulations, or third-party rights

4. Third-Party Services

Our App may integrate with or provide links to third-party websites, apps, or services. We do not control or endorse these third-party services, and your use of such services is subject to their own terms and privacy policies.

5. Updates to the App

We may from time to time develop and provide App updates, which may include upgrades, bug fixes, patches, and other error corrections or new features. You agree that we have no obligation to provide any updates or continue to provide or enable any particular features or functionality.

6. Intellectual Property Rights

The App and its original content, features, and functionality are owned by profileCraft and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Warranty Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE APP IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP.

9. Indemnification

You agree to defend, indemnify, and hold harmless profileCraft and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

10. Term and Termination

These Terms remain in effect until terminated by either you or us. You may terminate these Terms at any time by deleting the App from your device and discontinuing its use.

We may, at our sole discretion, terminate these Terms, suspend or terminate your access to the App, or remove any User Content, with or without notice, for any reason, including but not limited to, if we believe that you have violated or acted inconsistently with these Terms.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our website. If the changes are material, we may provide additional notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
